Terms of Service

Pixels71 is a brand operated by StaticMania Ltd ("Pixels71", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the website at pixels71.com (the "Site") and your purchase and use of the website templates and related digital products we sell (the "Products"). By using the Site or purchasing a Product, you agree to these Terms.

1. Who we are

StaticMania Ltd is a company registered in Bangladesh, with its registered office at 9/2 Khan Niketon, Garden Street, Ring Road, Dhaka-1207, Bangladesh. You can reach us at hello@pixels71.com.

2. Payments and Merchant of Record

Our order process and payments are conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders and handles customer service enquiries related to payments, billing, and taxes. When you buy a Product, your contract for that purchase is with Paddle, and Paddle's buyer terms also apply. Prices are shown at checkout and may include applicable sales tax or VAT, which Paddle calculates and collects based on your location.

3. Licence to use the Products

When you purchase a Product, we grant you a non-exclusive, worldwide, perpetual licence to use it, subject to these Terms and to the licence tier you buy. We offer two licence tiers:

• Single Licence. Use the Product in one end product (one website), for yourself or for a single client. You may modify and customise it freely.
• Extended Licence. Everything in the Single Licence, plus use in one end product where your end users are charged, and use in client work.

Under either licence you may not:

• Resell, redistribute, sublicense, or give away the Product files themselves, whether modified or unmodified.
• Include the Product in a template, theme, kit, or other product intended for resale or redistribution.
• Make the Product available for download, or share it on any file-sharing or public repository.
• Claim the Product, or a lightly modified version of it, as your own original work for redistribution.

4. Intellectual property

All Products, and all content on the Site, are the intellectual property of StaticMania Ltd and are protected by copyright and other laws. Your purchase grants you the licence described above; it does not transfer ownership of any intellectual property to you.

5. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

6. Disclaimer of warranties

The Products and the Site are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Products will meet your requirements or that their operation will be uninterrupted or error-free.

7. Limitation of liability

To the fullest extent permitted by law, StaticMania Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or the Products. Our total liability for any claim relating to a Product will not exceed the amount you paid for that Product.

8. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site or Products after changes take effect constitutes acceptance of the revised Terms.

9. Governing law

These Terms are governed by the laws of Bangladesh, without regard to its conflict-of-law provisions. The courts of Dhaka, Bangladesh will have exclusive jurisdiction over any dispute arising from these Terms, except where mandatory consumer-protection law in your country of residence provides otherwise.
